Terms and conditions of our policy

1. Vehicle Return
Customer acknowledges that he receives the vehicle with clean interior in good and safe mechanical, structural and cosmetic condition (except as may be otherwise indicated on the rental agreement).
The vehicle must be returned in the same condition as when received, to the address indicated on the rental agreement with specified date and time. If returned later, then 30 min grace period, late return fee and a daily rate charge will apply. To extend the rental period, please contact Customer Service at least 48 hours before the agreed time of return. Extension depends on availability.

2. Rental Charges
Renter shall pay:
Daily or weekly charges for the rental period.
The mileage charge for all miles exceeding any free miles allowed for the rental period.
-Refueling charge if the vehicle is returned with less fuel then when rented. There is no refund or credit will be issued if vehicle is returned with more fuel then when received it.
-All fines, parking tickets, penalties, traffic violations, court costs and administrative fees.
-Optional coverage, accessories and services accepted by renter on the rental agreement.
- All sales taxes, airport concession recovery and Colorado road safety fees.
Late drop off fee plus additional daily rate charge.
- Interior cleaning fee if vehicle returned with excessive stains, dirt, vomit or soilage.
- Smoking fee, if you smoke in our non-smoking vehicles.

3. Prohibited use and termination of rental
Any prohibited use of the vehicle will void any optional services that you have purchased including: roadside assistance, liability protection and collision damage waiver. Rental agreement will terminate automatically without further notice. To avoid prohibited use and termination of rental Customer agrees not to use vehicle:
-Without proof of valid primary insurance coverage.
- For the transportation for hire.
- In any race, competitive event or on unpaved road or off-road.
- For any illegal purpose.
- To drive recklessly.
- To carry loads beyond the vehicle s capability.
- To push or tow any vehicle.
To carry passengers in excess of the number of seatbelts.
Vehicle shall not be operated:
By anyone other than authorized drivers.
By anyone who doesn't meet driver's requirements.
By anyone, who obtained vehicle by fraud, or misrepresentation: has given false information, fictitious name, false address or a false or invalid driver's license.
-While the driver is under influence of alcohol, narcotics or drugs.

4. Authorized Drivers
Authorized Driver is the renter and any additional drivers listed on the rental agreement. Each Authorized Driver must be at least 25 years of age and have a valid driver's license. Daily fee will be added for each additional driver. Authorized Drivers are the only persons permitted to operate the vehicle. Renter is responsible for any losses or damages caused by any driver. Every authorized driver must appear at the time of the rental and sign the Additional Driver field. Driver's requirements:
Authorized Driver within the past 2 years has not been convicted of:
More than two moving violations
Seat belt law violations.
More than two accidents, regardless of fault.
Driving While Intoxicated (DWI), Driving Under the Influence (DUI), reckless driving or leaving the scene of an accident, hit and run. Driving with an invalid, suspended or revoked license.
In case of an accident you authorize Motion Rent A Car to verify and obtain a copy of your driving record and you authorize any motor vehicle department to provide copy of your record on Motion Rent A Car request. You certify that if you provide false information it will violate the rental agreement and use of the vehicle will be prohibited and will void any optional services that you have purchased including: roadside assistance, liability protection and collision damage waiver. You will be responsible for all loss or damages including liability to third party. Rental agreement will terminate automatically without further notice.

5. Collision Damage Waiver

Collision Damage Waiver (CDW) is available for purchase for an additional fee. (CDW) - is not insurance. It is a waiver of renter's financial responsibility to loss, damage or theft to Motion rental car, as long as renters will comply with terms and conditions of the Motion car rental agreement. Any prohibited use of the vehicle will void CDW and renter will be responsible for all loss or damage to the car. However, under CDW, bodily injuries or damages to your personal property are not covered. CDW does not apply to lost keys. By declining the waiver, you accept responsibility for any damages up to full value of the car. You acknowledge and may wish to check that your own personal insurance or credit card, that was used to pay for the reservation may provide that coverage for your rental.
6. Supplemental Liability Protection
Supplemental Liability Protection (SLP). If you are at fault in an auto accident, you may be responsible to pay damages to the person you injured and/or property you damaged. If accepted, SLP provides the renter and authorized drivers with up to $1,000,000 combined single limits for third party liability claims. long as renters will comply with terms and conditions of the Motion car rental agreement. Any prohibited use of the vehicle will void SLP and renter will be responsible
for any third party accident claim.
SLP does not provide coverage:
-For Uninsured Motorist/Underinsured Motorist (loss or damage caused by an at fault driver who does not have sufficient car insurance). Hit and Run accident
-For bodily injury or property damage sustained by you and/or your relatives residing with you, or by any authorized drivers and/or their relatives residing with them -For fines, penalties, exemplary or punitive damages (driver's willful acts were violent, fraudulent, wanton or grossly reckless).

7. Roadside Assistance Protection

Roadside Assistance Protection (RAP) service provides you with 24/7 towing service, not related to an accident, to the nearest service facility Motion Rental Car office, lock-out service, if the keys are locked inside the vehicle, flat tire service with spare tire replacement, fuel delivery service and dead battery jumpstart during your rental. Any prohibited use of the vehicle will void this protection. RAP does not apply to lost keys and it is renter's responsibility. 8. Accidents, theft, damage or loss to the vehicle
Renter is liable to report all accidental collision damages on the rented vehicle, loss or theft to local Police authorities at the place of the accident, providing the official Police report and to provide written accident report at the Motion Rent A Car office, regardless of purchasing CDW. In case if the rented vehicle s accidental damage was not reported or was reported not properly to the Police, renter will be liable to pay full value of the damage, regardless of purchasing CDW. Renter shall secure the vehicle from the accident place and deliver to Motion Rent A Car office any paper or notice related to the claim involving the vehicle. Renter can cover the liability for all damages, loss or theft by purchasing CDW before rental. If the vehicle was left unlocked or with the keys inside or with opened windows or trunk and was stolen or vandalized, renter agrees to accept full responsibility and shall pay up to full value of the rented vehicle. If CDW coverage was declined, or voided by prohibited use and the vehicle is damaged, lost or stolen, renter is responsible to pay Motion Rent A Car all repair cost, 14% administrative fee, full value of the car, if was stolen, or full value of the car before it was damaged less its salvage value, loss of use of the car, equal to the vehicle's daily rate, regardless if the vehicle was sold out or not and who is at fault.

9. Smoking Policy
Non-smoking fleet. $300 smoking fee will be charged, if you smoke in our non-smoking vehicles.

10. Lost and Found
Motion Rent A Car is not responsible for any loss or damage to any property left in or on the car or courtesy vehicle. Please contact Customer Service immediately and we will make every effort to find it.

11. Cancellation Policy
All reservations cancelled more than 7 days in advance from the vehicle pickup time will receive a full refund. All reservations cancelled less than 7 days in advance from the vehicle pickup time will not receive a refund and will be charged for the full rental period.

12. Early Return

There is no refund for early return.
